1. Introduction
These Terms & Conditions ("Terms") govern your use of PitchLab ("the Service"), operated by Pitchmaster ("we", "us", or "our"). By accessing or using PitchLab, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
2. Our Service
PitchLab is a browser-based vocal practice platform that provides real-time pitch detection, a library of vocal exercises and songs, and an optional AI-powered vocal coach ("Aria"). Some features are free; others require a paid subscription.
3. Acceptable Use
You agree not to misuse the Service. Specifically, you must not:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Engage in fraud, spam, or deceptive practices.
- Infringe on intellectual property rights of others.
- Interfere with or disrupt the Service, servers, or networks connected to the Service.
- Attempt to gain unauthorized access to any part of the Service.
- Use automated scripts, scrapers, or bots to access the Service.
4. AI Vocal Coach (Aria)
Aria is an optional AI feature that generates responses and coaching guidance based on your input. By using Aria, you acknowledge and agree that:
- You are responsible for the prompts you provide and how you use the AI-generated outputs.
- You will not use Aria to generate illegal content, hate speech, harassment, malware, or content that infringes on the rights of others.
- AI-generated outputs may not always be accurate or appropriate for your specific needs. You should verify important information independently.
- We reserve the right to review, filter, or remove prompts and outputs that violate these Terms, and to suspend or terminate accounts for repeated violations.
- You retain ownership of your inputs. You grant us a limited license to process your inputs solely to provide the AI coaching service.
5. Intellectual Property
We retain all rights, title, and interest in and to the Service, including all software, documentation, branding, and content (excluding your own inputs and user content). You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial purposes in accordance with your selected plan.
6. Payments and Subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
For details on payment, billing, tax, cancellation, and refund mechanics, please refer to Paddle's Buyer Terms.
Subscriptions automatically renew unless cancelled before the next billing period. You can manage or cancel your subscription through Paddle's customer portal.
7. Account and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating an account and keep it updated.
8. Termination
We may suspend or terminate your access to the Service at any time, without prior notice, for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. Upon termination, your right to use the Service ceases immediately.
9. Service Level
We do not guarantee that the Service will be uninterrupted or error-free. The Service is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by law.
10. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability shall be limited to the amount you paid for the Service in the six (6) months preceding the claim. We shall not be liable for any indirect, consequential, or special damages, including loss of profits, data, or goodwill, except where liability cannot be excluded by law (such as fraud, death, or personal injury).
11. Indemnity
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your user content, or your violation of these Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Pitchmaster operates, without regard to conflict of law principles.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on this page with a revised date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
